Permit: Feb. 19, 2020, Paul McAuliffee approved zoning permit for 50,000 cy to build a 2 acre bog. No special permit needed. October 2022 town of Plymouth requests a preliminary injunction. Court order ceased further excavation until property installed erosion control. December 2022 town files for an emergency motion for a temporary restraining order to cease additional excavation until further stormwater and erosion management is installed on property designed by a professional engineer. Defendant failed to meet these terms. January 2023, Town of Plymouth files first complaint for civil contempt for repeated incompliance to court orders that resulted in uncontrolled stormwater impacting abutting residents. In April 2023 court required “stop gap” measures to be put in place to prevent stormwater runoff from property. In September 2023 Town filed a second complaint for defendants failure to follow previous conditions of court orders. In January 2024, Town files third complaint for enforcement finding the defendant in civil contempt to comply with previous court orders.
