  • Wetlands and Waterways: Yes. Although Mass DEP ruled in July 2022 that the mining activity is exempt from the Wetlands Protection Act as “normal improvement of land in agricultural use.” This was in response to Save the Pine Barrens Request for Determination of Applicability.
